Welcome to Eminent Safaris. By booking a tour or safari experience with us, you agree to the following terms and conditions. Please read them carefully before making a reservation.
1. Booking & Confirmation
All bookings are subject to availability and confirmation by Eminent Safaris. A booking is only confirmed upon receipt of the required deposit and a written confirmation from our team. Verbal agreements or provisional bookings do not constitute a confirmed reservation.
To secure your booking, a non-refundable deposit of 30% of the total tour cost is required at the time of reservation. The remaining balance must be paid at least 30 days before the tour departure date. For bookings made within 30 days of departure, full payment is required at the time of booking.
2. Payment Terms
Payments can be made via bank transfer, credit/debit card, or mobile money (M-Pesa). All prices are quoted in US Dollars (USD) unless otherwise stated. Eminent Safaris reserves the right to adjust prices due to currency fluctuations, increased park fees, fuel surcharges, or government-imposed taxes. Any price changes will be communicated before final payment.
3. Cancellation Policy
Cancellations must be submitted in writing to tours@eminentsafaris.com. The following cancellation fees apply based on the notice period before the scheduled departure date:
- 60+ days before departure: Deposit forfeited; remaining balance refunded in full
- 30-59 days before departure: 50% of the total tour cost
- 15-29 days before departure: 75% of the total tour cost
- Less than 15 days before departure or no-show: 100% of the total tour cost (no refund)
Refunds will be processed within 14 business days of the cancellation confirmation. Eminent Safaris reserves the right to cancel any tour due to unforeseen circumstances (e.g., natural disasters, political unrest, pandemics). In such cases, clients will be offered a full refund or the option to reschedule at no additional cost.
4. Travel Insurance
Comprehensive travel insurance is mandatory for all safari and tour participants. Your insurance must cover trip cancellation, medical emergencies, evacuation (including air ambulance), personal belongings, and third-party liability. Eminent Safaris will not be held responsible for any costs arising from incidents that would have been covered by appropriate travel insurance. Proof of insurance may be requested prior to departure.
5. Passports, Visas & Documentation
It is the traveller’s responsibility to ensure they hold a valid passport (with at least six months’ validity beyond the travel dates) and the required visas for Kenya, Tanzania, Uganda, or any other destination included in their itinerary. Eminent Safaris can provide guidance on visa requirements but accepts no liability for denied entry due to improper documentation. We recommend applying for East Africa e-Visas well in advance of your travel dates.
6. Health & Vaccination Requirements
Travellers are responsible for consulting their healthcare provider regarding vaccinations, medications, and health precautions for travel to East Africa. A Yellow Fever vaccination certificate is required for entry into Kenya, Tanzania, and Uganda. Malaria prophylaxis and other health precautions are strongly recommended. Eminent Safaris accepts no responsibility for any illness contracted during a tour.
7. Limitation of Liability
Eminent Safaris acts as an agent for hotels, lodges, camps, airlines, ground transport operators, and other service providers. While we exercise due diligence in selecting reputable partners, we cannot be held liable for:
- Injury, illness, death, loss, or damage to property during a tour
- Delays, cancellations, or changes caused by airlines, weather, political events, or other factors beyond our control
- Acts of God, force majeure, or unforeseen circumstances
- The actions or negligence of third-party service providers
Participation in safari activities, game drives, nature walks, water sports, and other adventure experiences is at the traveller’s own risk.
8. Changes to Itinerary
Eminent Safaris reserves the right to modify itineraries when necessary due to weather conditions, road conditions, park closures, wildlife migration patterns, or other circumstances beyond our control. We will always endeavour to provide suitable alternatives of equal or higher quality. No refunds will be issued for minor itinerary adjustments. If a significant change materially affects the tour, we will discuss alternatives or offer appropriate compensation.
9. Behaviour & Conduct
All travellers are expected to behave responsibly and respectfully during tours. This includes following the instructions of guides and park rangers, respecting wildlife and local communities, and adhering to the rules and regulations of national parks and conservation areas. Eminent Safaris reserves the right to remove any participant whose behaviour endangers themselves, other travellers, wildlife, or the environment — without refund.
10. Photography & Media
Eminent Safaris may take photographs or videos during tours for promotional purposes. By participating in a tour, you consent to the use of such images unless you notify us in writing prior to departure that you do not wish to be photographed.
11. Complaints Procedure
We are committed to providing exceptional safari experiences. If you encounter any issues during your tour, please raise them immediately with your guide or tour leader so we can address them on the spot. For complaints after your tour, please submit them in writing to tours@eminentsafaris.com within 14 days of the tour completion date. We will acknowledge receipt within 48 hours and provide a full response within 14 business days.
12. Governing Law
These terms and conditions are governed by the laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the jurisdiction of the courts in Nairobi, Kenya.
